After Rs 4,700 crore election spending, Musk faces threat of Democratic investigations

Democrats' reported takeover of both chambers of Congress raises the prospect of investigations into Tesla, SpaceX and Musk's government dealings

Billionaire Elon Musk's massive financial investment in the 2026 US midterm elections has come under scrutiny after Democrats reportedly secured control of both chambers of Congress, raising the prospect of congressional investigations into his business empire and ties with President Donald Trump's administration.

Musk, who spent nearly half a billion dollars, or approximately Rs 4,700 crore, supporting Republican candidates and causes, emerged as one of the prominent financial backers of the party's campaign.

The Tesla and SpaceX chief had also invested more than $250 million in supporting Trump's successful 2024 presidential campaign, making him one of the most influential political donors associated with the Republican Party.

Despite his financial backing, Republicans suffered significant setbacks in Tuesday's elections. Democrats also captured the Texas governorship, with Gina Hinojosa defeating Republican incumbent Greg Abbott, ending more than three decades of Republican control of the office.

The results have intensified speculation that Democratic lawmakers could use their newly acquired congressional powers to examine Musk's companies, government contracts and involvement in federal policymaking.

Ahead of the elections, Musk had publicly urged his followers on X to support Republican candidates.

However, reports that Democrats were preparing investigations into his businesses prompted a sharp response from the billionaire.

Reacting to a report about possible congressional scrutiny, Musk wrote on X on October 21: "Live by the sword, die by the sword."

He further warned that those who initiated confrontations with him should expect retaliation, saying he would seek to identify the individuals behind such efforts.

The remarks reflected growing tensions between Musk and Democratic lawmakers, who have repeatedly questioned his influence over government policy and the financial relationships between his companies and federal agencies.

Democratic lawmakers have raised concerns about several aspects of Musk's business and political activities, including federal contracts awarded to his companies, government subsidies and his involvement in the Department of Government Efficiency (DOGE).

Musk's role in overseeing sweeping federal workforce reductions during his association with DOGE has been particularly controversial.

His companies also maintain extensive commercial relationships with the US government, including contracts involving satellite communications, space launches and other technology services.

Democrats have questioned whether Musk's proximity to the Trump administration created potential conflicts of interest, particularly where government decisions could affect his commercial operations.

Following the election results, Democratic Congressman Robert Garcia, who is expected to chair the House Oversight Committee, issued a warning to Trump, his family and members of his administration.

"Lawyer up," Garcia said.

The House Oversight Committee possesses extensive investigative powers, including the authority to seek documents, summon witnesses and issue subpoenas.

Democratic control of the committee could therefore expose Musk and senior executives of his companies to more intensive questioning about their government dealings.

Texas presents a particular challenge for Musk because the state is home to major operations of Tesla and SpaceX, along with planned investments in semiconductor manufacturing and artificial intelligence infrastructure.

Incoming Democratic Governor Gina Hinojosa has previously challenged the state's relationship with Musk's businesses, including the incentives and regulatory concessions offered to large technology companies.

Hinojosa has called for a halt to new data centre projects until stronger protections are introduced for local communities. She has also opposed certain tax concessions and questioned proposals involving state-owned land near SpaceX's Starbase facility.

Her position could complicate Musk's plans to expand computing infrastructure in Texas, particularly as demand for electricity-intensive AI data centres continues to rise.

The billionaire has responded to the changing political environment with apparent humour, suggesting on X that space-based data centres were becoming increasingly attractive.

The election results also weighed on Musk's publicly traded companies, with Tesla and SpaceX shares falling approximately five per cent in Wednesday's trading, according to market reports.

Investors are assessing whether greater regulatory scrutiny and potential restrictions on data centre construction could affect the companies' expansion plans.

SpaceX has been investing heavily in artificial intelligence infrastructure, including its Colossus computing facilities near Memphis, Tennessee.

The company has outlined ambitious plans to expand its computing capacity, making timely regulatory approvals and access to electricity important to its growth strategy.

Any delays could increase project costs and complicate efforts to meet revenue expectations.

However, congressional investigations would not automatically result in financial penalties, cancelled contracts or restrictions on the companies. Such outcomes would depend on the findings of investigations and subsequent legal or regulatory decisions.

Musk's political spending made him one of the largest individual contributors to Republican electoral efforts, but the results demonstrated the limits of financial backing in determining election outcomes.

Democrats are expected to assume control of the new Congress in January, when they will gain the authority to set committee agendas and pursue investigations into the Trump administration and its allies.

For Musk, the immediate challenge is managing a changed political environment while protecting the commercial interests of companies dependent, in varying degrees, on government contracts, regulatory approvals and public infrastructure.

The extent of future congressional scrutiny remains uncertain, but the midterm results have substantially altered the political landscape in which his businesses operate.
